b. Obtaining support for geoXtract software that you have licensed from us, to the extent such support is made available by us, provided you are in fully in compliance with all the terms of such license.

c. For licensees of geoXtract software that include access to this website to publish User Publications, and subject to the license(s) for such software, posting User Publications on this website but only as permitted herein and by such licenses. You are not permitted to use this website for any other purpose. We reserve the right to discontinue this website or any Content or User Publication at any time without reason therefor or notice thereof. You may not frame or utilize framing techniques to enclose this website or any Content without our express prior written approval. You may not link to this website without our express prior written approval. Linked third party websites are not under the control of LefseSoft and LefseSoft is not responsible for the availability or contents of any linked website or any link contained in a linked website. Certain licensees of geoXtract software may post on this website Internet map "mashups" that they produce with the aid of such software, subject to the licenses for such software (each a "User Publication"). User Publications may be modified at any time without notice by geoXtract or its licensors, including as a result of the display of commercial information drawn from third-party APIs or other products or services.

10. Controlling Law and Severability; Other

These Terms of Use will be governed by and construed in accordance with the laws of the State of Oregon, as applied to agreements entered into and to be performed entirely within Oregon between Oregon residents. These Terms of Use shall not be governed by the United Nations Convention on Contracts for the International Sale of Goods, the application of which is expressly excluded. If for any reason a court of competent jurisdiction finds any provision, or portion thereof, to be unenforceable, the remainder of these Terms of Use shall continue in full force and effect. In the event of any dispute between or among you, any person or entity acting by or through you, and geoXtract, such dispute will be subject to the exclusive jurisdiction of the State and Federal courts sitting in the City of Portland, State of Oregon, provided that geoXtract may initiate claims, litigation or judicial procedures in any jurisdiction as necessary to protect geoXtract's intellectual property. You agree that any notice given to you by geoXtract by e-mail, by posting on the geoXtract URL: http://www.geoXtract.com, or through any other electronic means is acceptable to you. geoXtract, and only geoXtract, may modify these Terms of Use at any time by notifying you pursuant to the means identified in the immediately preceding sentence; if you disagree with any modification of these Terms of Use, your sole recourse is to immediately cease all use of this website and any products or services made available by geoXtract.

11. Complete Agreement; Governing Law

This License constitutes the entire agreement between the parties with respect to the subject matter thereof and supersedes all prior or contemporaneous understandings regarding such subject matter. No amendment to or modification of this License will be binding unless in writing and signed by geoXtract. Any translation of this License is done for local requirements and in the event of a dispute between the English and any non-English versions, the English version of this License shall govern.

12. Certain Terms

When we use the term geoXtract, us, we, our, or similar designation in the context of describing an entity, we mean LefseSoft Technologies, LLC. Effective as of February 1, 2008.
